• You must be at least 16 years old (or the minimum age required in your jurisdiction to consent to the processing of your personal data) to create an account.
• You must provide accurate, current, and complete information during registration and keep your account information up to date.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• Notify us promptly of any unauthorized access to your account.

You agree not to:

• Violate any applicable law or regulation.
• Infringe the intellectual property or privacy rights of others.
• Upload, store, or transmit content that is unlawful, harassing, defamatory, or harmful.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Use automated means (scraping, crawling, bots) to access the Service in a way that exceeds reasonable use, except for publicly documented APIs.
• Reverse-engineer, decompile, or attempt to extract source code, except to the extent permitted by law.
• Interfere with or disrupt the integrity or performance of the Service.
• Resell, sublicense, or commercially exploit the Service without our written consent.

You retain all rights to the content you create in the Service — including your values, objectives, key results, practices, check-in entries, and reflections (collectively, "Your Content").

You grant us a limited, worldwide, royalty-free license to host, store, process, and display Your Content solely for the purpose of operating and improving the Service for you. This license terminates when you delete Your Content or your account, subject to our retention obligations as described in our Privacy Policy.

You are responsible for Your Content. You represent that you have the rights necessary to grant the license above and that Your Content does not violate these Terms or any third-party rights.

Export. You may request a machine-readable export of Your Content at any time by contacting us at legal@whyokr.app. We will provide it within a reasonable timeframe and at no cost.

The Service is currently provided free of charge. We may introduce paid plans or features in the future. If we do, we will give you advance notice of any pricing that applies to your account, and you will not be charged for premium features unless you affirmatively opt in.

For any paid offering, fees are non-refundable except as required by applicable law or as expressly stated at the time of purchase.

The Service, including the whyokr.app name, logo, software, and website, is owned by whyokr.app and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal business purposes, subject to these Terms.

We aim to keep the Service available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will use reasonable efforts to provide notice of material changes that adversely affect your use.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if your use poses a risk to us or others, or as required by law. On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including ownership, disclaimers, and limitations of liability) will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED.

The Service is not a substitute for professional advice (medical, mental-health, legal, financial, or otherwise). You are solely responsible for the decisions you make using the Service.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WHYOKR.APP OR ITS AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

To the extent permitted by law, you agree to indemnify and hold harmless whyokr.app and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content; (b) your use of the Service in violation of these Terms; or (c) your violation of applicable law or third-party rights.

These Terms are governed by the laws of Sydney, NSW, Australia, without regard to its conflict-of-laws principles. The exclusive venue for any dispute arising out of or related to these Terms or the Service will be the courts located in Sydney, NSW, Australia, and you consent to personal jurisdiction there.

Nothing in this section limits any non-waivable rights you have under the law of your country of residence as a consumer.

We may update these Terms from time to time. When we make material changes, we will update the effective date above and, where appropriate, notify you within the Service or by email. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

• Entire agreement: these Terms, together with our Privacy Policy, form the entire agreement between you and us regarding the Service.
• Severability: if any provision is held unenforceable, the remaining provisions will remain in full effect.
• No waiver: our failure to enforce any provision is not a waiver of that provision.
• Assignment: you may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
